CONTENT CREATOR AGREEMENT & TERMS OF SERVICE

1. Eligibility and Creator Status

1.1. To participate in the monetization program on PRASENI.COM, you must be at least 18 years of age and successfully complete our mandatory Identity Verification (KYC) and biometric "selfie" check.
1.2. Membership Requirement: Access to monetization features is strictly tied to an active Membership Package that supports creator tools. If your membership expires, you will be unable to generate new revenue until it is renewed.
1.3. You operate as an independent contractor. No employment, agency, or partnership is created by this agreement.

2. Legal Compliance and Record Keeping (18 U.S.C. § 2257)

2.1. You represent and warrant that you maintain professional records for all individuals depicted in your content, proving they were 18+ at the time of production.
2.2. You agree to provide copies of IDs and signed "Model Release" forms to the Operator immediately upon request.
2.3. Failure to provide documentation within 48 hours of a request will result in immediate account suspension and withholding of funds.

3. Content Standards and Prohibitions

3.1. Zero Tolerance: You are strictly prohibited from uploading content depicting:

• Minors or anyone appearing to be under 18.

• Non-consensual sexual content (revenge porn).

• Illegal acts, violence, bestiality, or necrophilia.

3.2. Escort Prohibition: You must not use the Platform to offer, solicit, or advertise physical sexual services, escort services, or in-person meetings for compensation. Any mention of external prices for physical services will lead to an immediate permanent ban and forfeiture of all earnings.

4. Revenue Share and Fees

4.1. Revenue Share: Creators receive 80% of the net revenue generated from their content (subscriptions, paid posts etc.).
4.2. Platform Fee: The Operator retains a 20% Platform Fee to cover hosting, streaming costs, administration, and payment processing.

5. Payouts and Withdrawals

5.1. Minimum Payout: The standard minimum withdrawal amount is 100 EUR.
5.2. Requesting Funds: Payouts must be requested manually via the dashboard: https://www.praseni.com/settings/monetization/payments (Settings/Monetization/Payments).
5.3. Processing: Requests are reviewed within 3 business days. Approved funds are sent via Bank Transfer (IBAN/SWIFT).
5.4. Account Closure Exception: If you close your account with a balance below 100 EUR, you may request a final payout subject to a 15% Administrative Closure Fee (minimum 5 EUR).
5.5. Chargebacks: If a transaction is reversed by a user's bank (chargeback), the Operator will deduct the full amount from your balance. If your balance is insufficient, the amount will be deducted from future earnings.

6. Taxation and DAC 8 Reporting

6.1. Pursuant to EU Directive 2021/514 (DAC 8), the Operator is legally mandated to report your identity, residency, and annual earnings to tax authorities.
6.2. You are solely responsible for reporting and paying all applicable taxes and social contributions in your jurisdiction.

7. Account Deletion and Forfeiture

7.1. You must withdraw all eligible funds before deleting your account.
7.2. Upon account deletion, all personal data is removed (pursuant to GDPR), and any remaining balance is permanently forfeited and cannot be claimed thereafter.

8. Governing Law

This agreement is governed by the laws of the Czech Republic. Any disputes shall be settled by the competent courts of the Czech Republic.
