1. Introductory Provisions

(hereinafter referred to as the "Operator" or "PRASENI.COM")

These Terms of Use (hereinafter referred to as "TOU") govern the rights and obligations between the Operator and the users ("User" or "You"). By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these TOU. PRASENI.COM is a Czech platform, and all transactions are processed in the Czech Republic.

2. Eligibility and Protection of Minors
This Site is intended exclusively for persons over the age of 18. By using this Site, you solemnly declare that you have reached the age of 18 and have full legal capacity.

Zero Tolerance for CSAM: Any content depicting minors will be immediately deleted, the account banned, and reported to law enforcement (NCMEC, ASACP, or Czech Police).

3. Nature of Service and Escort Prohibition
PRASENI.COM is a platform for sharing digital content only. It is strictly forbidden to use the Platform to offer, solicit, or advertise prostitution, escort services, or any physical sexual services. The Operator is an information society service provider under Act No. 480/2004 Coll. and does not conduct criminal background checks.

By uploading content to PRASENI.COM, you retain your ownership rights. However, you grant the Operator a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, use, display, reproduce, and distribute such content for the sole purpose of operating and promoting the Platform. You represent that you own all rights to the content you upload.

4. Payment Terms and Billing
Certain features are subject to a fee. All prices listed on the platform are final and inclusive of VAT (where applicable).

Credits: Credits are used to unlock digital content. Top-ups are available from 5 EUR to 500 EUR.

Billing Descriptor: Card payments will appear on your bank statement under the descriptor provided by our payment processor (e.g., VTS*PRASENI.COM or vtsup.com).

Authorization: By entering payment details, you authorize us and our payment processor (Verotel) to charge the respective amount.

5. Complaints and Refund Policy
Immediate Access: In accordance with Section 1837(l) of the Czech Civil Code, the user expressly agrees that digital content is made available immediately. By this consent, the user loses the right to withdraw from the contract within 14 days without giving a reason.

Refunds: Due to the nature of digital content, refunds are generally not provided unless a technical error occurred (e.g., duplicate charge). Contact support at admin@praseni.com for assessment.

Billing Support: For specific payment inquiries, you may also contact our processor Verotel at https://vtsupport.com.

Chargebacks: Unauthorized chargebacks are considered fraudulent and will lead to a permanent ban and blacklisting.

6. Content Moderation
The Operator undertakes to review all reports of illegal content (Abuse Reports) within 24 hours. Prohibited content includes: non-consensual material, violence, drugs, or minors. Violation leads to immediate removal and account termination.

7. Biometric Data and 18 U.S.C. § 2257
To ensure legal compliance, we use age verification systems. Documentation is maintained in accordance with Record Keeping Requirements under 18 U.S.C. § 2257 and relevant Czech laws. Data is stored securely and used solely for legal compliance.

8. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Czech Republic.

Out-of-court settlement (ADR): Consumers may submit a proposal for settlement to the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 15, 120 00 Prague 2, Web: adr.coi.cz.

9. Content Creators

Creators are subject to the additional Content Creator Agreement (https://www.praseni.com/static/CCA), which governs revenue share, DAC 8 tax reporting, and payout terms.

10. Limitation of Liability

The Site is provided "AS IS." The Operator shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or goodwill, arising from your use of the Site. We do not guarantee 100% uptime.

11. Advertising and Promotions

Users may create and run advertising campaigns to promote their own products or services on the Platform.
Compliance: All promotional activities must comply with applicable laws and the Platform's Content Policy.
Fees: Advertising campaigns are subject to a fee. The specific cost is displayed to the User before the campaign starts.
Payment: Fees are automatically deducted from the User’s credit balance (Wallet). The User must ensure sufficient credit is available before launching a campaign.
Moderation: The Operator reserves the right to review, reject, or remove any advertisement that violates these Terms.

12. Indemnification

You agree to indemnify and hold Avantura s.r.o. harmless from any claims, damages, or legal fees resulting from your breach of these Terms, your violation of any law, or your infringement of any third-party rights.
